Google Tried to Buy Lala: Lost to Apple

Apple wasn’t the only company chasing Web-based music startup Lala, it seems; Google was also in hot pursuit, with aspirations to delve deeper into the online music business.

Apple and Psystar strike deal over cloned Macs

Apple and Psystar have struck a deal to settle out of court over the dispute about non-Apple branded machines running its operating system.

Psystar has agreed a settlement to pay damages to Apple over the computers it sells with the company’s software on it, but will only pay up once all appeal routes have been explored.

It appeared Apple had crushed Psystar’s bid to keep selling the machines earlier this month, but the new deal means there’s a ray of hope for the small US firm yet.

Shifting responsibility

According to Computer World, Psystar may now look to still sell the machines but make it the responsibility of the consumer to install the OS on the computers.

Instead of shipping Psystar machines with OSX installed, the company wants to simply sell the hardware and its Rebel EFI software, which facilitates the installation of Apple’s OS on the computer.

This would mean the consumer would have to go out and obtain a copy of the OS themselves, thus relieving Psystar of the burden.

“Psystar and Apple today entered into a partial settlement that is embodied in a stipulation that will be filed with the Court tomorrow,” the motion read.

“Psystar has agreed on certain amounts to be awarded as statutory damages on Apple’s copyright claims in exchange for Apple’s agreement not to execute on these awards until all appeals in this matter have been concluded. Moreover, Apple has agreed to voluntarily dismiss all its trademark, trade-dress, and state-law claims.”

Windows 7 Share Grows At XP’s Expense

CWmike writes “Microsoft’s Windows ran to stay in place last month as Window 7’s market share gains made up for the largest-ever declines in Windows XP and Vista, data released today by Web metrics firm Net Applications showed. By these numbers, Windows 7’s gains were primarily at the expense of Windows XP. For each copy of Vista replaced by Windows 7 during November, more than six copies of XP were swapped out. Meanwhile, Apple’s Mac OS X lost share during November… betcha Ballmer is having an extra giddy time with that news. Linux came up a winner last month, returning to the 1% share mark for the first time since July. Linux’s all-time high in Net Applications’ rankings was May 2009, when it nearly reached 1.2%.”

Psystar Reaches Settlement with Apple, May Get to Keep Selling Hackintoshes

When is a settlement not a settlement? Could just be what Psystar and Apple are reported to have agreed to in Apple’s long-running legal dispute with the upstart clone maker.

The dispute centers on Psystar’s installation of Apple’s OS X, version 10.5 (a.k.a. Leopard) on Intel-based computers manufactured by Psystar. Apple took exception to Psystar’s hackintosh and sued, with its complaint upheld by a Federal Court in San Francisco. The Court agreed not only to Apple’s claim of copyright infringement, but to Pystar’s violation of the Digital Millennium Copyright Act (DMCA) for the unauthorized installation of OS X.

According to a motion Psystar filed with the Court Monday, Psystar states that it and Apple have reached a partial settlement, in which Psytar agrees to pay Apple damages for violating Apple’s copyright–an estimated $2.1 million. But, only after Psystar has exhausted all of its avenues for appeal. Psystar is hoping this will placate Apple and the Court enough that it can escape a permanent injunction Apple has requested that would shut Psystar down.

Psystar has also asked that it’s Rebel EFI utility be excluded from any injunction. Rebel EFI, which is sold separately, is used to load OS X onto its systems. With Rebel EFI buyers of Psystar’s desktops are able to install OS X themselves, rather than have it preloaded by Psystar, effectively allowing Psystar to remain in the hackintosh business.

Apple may have agreed to drop its copyright infringement claims against Psystar for the promise of a possible future payment. But it’s not clear that Apple is in agreement with Psystar’s continued sale of Rebel EFI, if Apple’s intent is to limit the hackintosh market. It would seem that the dust from this dispute has yet to settle.

Apple Not Disabling OS X Atom Support After All
